Refund Policy

At Ziphaus, we are dedicated to providing exceptional creative services, digital products, merchandise, and event experiences. To maintain transparency and safeguard our operations, the following refund policy applies to all transactions. By purchasing from Ziphaus, you agree to these terms. Ziphaus Fulfillment Policy.

1. Creative Services

  • All completed creative services are non-refundable and must be paid in full. This includes projects delivered in part or in whole, where substantial progress has been made.

  • Deposits or retainers paid for creative services are non-refundable, as they secure your project in our schedule.

  • If a project is canceled by the client after work has begun, the client will be responsible for payment proportional to the amount of work completed. Substantial progress will be determined based on project milestones and deliverables, as outlined in the service agreement.

 

 

2. Digital Downloads

  • All sales of digital downloads are final and non-refundable due to the nature of the product. Once purchased, digital files cannot be returned, exchanged, or revoked.

  • If technical issues prevent access to a digital download, customers must contact us at hello@ziphaus.com within 7 days of purchase for resolution.

3. Merchandise

  • All merchandise sales, including apparel, accessories, and artist-signed items, are final and non-refundable.

  • Exchanges may be offered solely for defective or damaged items upon receipt. Requests for exchanges must be submitted within 14 days of delivery and include proof of purchase and photographic evidence of the defect.

Event-Specific Tickets

Tickets purchased through Ziphaus for exclusive experiences or events are non-refundable and non-transferable, unless explicitly stated otherwise in writing.

  • Hosting Event Cancellations or Disruptions: If the hosting event is canceled, rescheduled, or significantly altered due to circumstances beyond Ziphaus's control, including but not limited to organizer decisions, weather, or acts of God, Ziphaus is not liable for refunds or covering related costs. Customers may need to refer to the hosting event’s policies for potential remedies, as Ziphaus operates as an independent vendor and cannot guarantee compensation for such cancellations.

  • Talent No-Shows or Program Changes: Ziphaus reserves the right to modify the advertised schedule, talent appearances, or program details at its discretion. If advertised talent is unable to appear, Ziphaus will make reasonable efforts to find suitable replacements or adjust programming. Refunds will not be issued for talent changes or program adjustments.

  • Force Majeure: If the Ziphaus Experience or event is canceled or impacted due to events beyond our reasonable control (e.g., natural disasters, government restrictions, or other unforeseeable circumstances), Ziphaus is not liable for refunds or associated costs. However, we may provide credits or alternative options at our discretion.

  • Customer Acknowledgment

  • By purchasing tickets for Ziphaus Experiences or other event-specific offerings, customers acknowledge and agree that:

  • Events are subject to change or cancellation without notice due to circumstances outside of Ziphaus’s control.

  • Refunds, if applicable, will be issued solely at Ziphaus's discretion and in accordance with this policy.

  • Ziphaus's liability is limited to the cost of the ticket purchased directly through Ziphaus, and we are not responsible for additional expenses such as travel, lodging, or other costs incurred by the customer.

5. Late Payment Conditions

  • All invoices are due upon receipt unless otherwise stated in writing. Payments not received within 15 days of the invoice date will incur a late fee of 10% of the outstanding balance or $50, whichever is greater, per 30-day period of delay.

  • If payment remains outstanding beyond 30 days, Ziphaus reserves the right to suspend or terminate services and may pursue legal action to recover the owed amount, including additional fees incurred during the collection process.

  • Clients with late payments may forfeit any rights to discounts, negotiated rates, or future preferential terms.

  • Work product, deliverables, and intellectual property remain the sole property of Ziphaus until full payment is received. Unauthorized use of unpaid work constitutes a breach of this policy and may result in legal action.

6. Payment Channels

  • Ziphaus uses payment channels provided by Wix, including credit card processing and other secure payment solutions.

  • By using these payment channels, you agree that Ziphaus is not liable for any issues arising from the payment provider, including but not limited to card fraud, data breaches, or unauthorized access to your payment information.

  • In the event of any payment-related issues, customers must contact the payment provider directly for resolution. Ziphaus is not responsible for resolving disputes or providing refunds related to payment processing errors or third-party breaches.

7. General Terms

  • Refund requests based on dissatisfaction with creative direction, subjective preferences, or personal opinions will not be honored. Open communication during the project or purchase process is encouraged to ensure alignment with expectations.

  • Refunds, if applicable and approved, will be processed within 10 business days. Approved refunds will only be issued to the original payment method.

  • By purchasing any product or service, you acknowledge that all intellectual property and completed work remain the property of Ziphaus until full payment is received.

8. Limitation of Liability

  • Ziphaus and its representatives are not liable for damages arising from the use or inability to use our products or services, including but not limited to lost data, revenue, or profits.

  • Ziphaus is not responsible for delays or disruptions caused by external factors, including shipping delays, technical issues, or event cancellations.

9. Policy Updates

  • Ziphaus reserves the right to modify or update this refund policy at any time without prior notice. The latest version of the policy will always be available on our website.

10. Disputes

  • Any disputes arising from this policy or transactions with Ziphaus will be governed by the laws of the State of Texas. You agree to submit to the exclusive jurisdiction of the courts located in Texas.

  • Disputes regarding transactions must be submitted in writing to hello@ziphaus.com within 30 days of the transaction date.

11. Force Majeure

  • Ziphaus is not liable for any failure to fulfill obligations due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, government actions, labor strikes, or technical failures.
